Terms of Service

These Terms of Service govern the relationship between Bombay Media (operated by Farhan Rakhangi and Akshay Aswani) and our clients. By engaging our services, you agree to these terms.
1. Services
Bombay Media provides done-for-you digital marketing services including Meta Ads management, AI-powered creative production, funnel strategy, and performance reporting for online coaches and course creators. The specific scope of services for each client is defined in the signed Service Agreement or Statement of Work (SOW).
2. Engagement & Payment
Services are billed monthly in advance unless otherwise agreed in writing. Invoices are due within 7 days of issue. Late payments may result in a pause or suspension of services. Ad spend is billed separately and must be funded directly by the client via their own ad account. Bombay Media does not hold client ad budgets.
3. Performance Guarantee
Where a performance guarantee is offered (e.g. 3x ROI in 90 days), the specific terms, measurement methodology, and remedies are defined in the client's individual Service Agreement. The guarantee applies only to clients who meet all onboarding requirements, provide timely approvals, and maintain the agreed minimum ad spend throughout the guarantee period.
4. Intellectual Property
Creative assets, copy, and strategic frameworks produced by Bombay Media during an active engagement are licensed to the client for use in their business. Bombay Media retains ownership of its proprietary methodologies, AI systems, templates, and internal processes. Upon termination, licenses for delivered assets transfer to the client; access to Bombay Media's tools and systems does not.
5. Confidentiality
Both parties agree to keep confidential any non-public information shared during the engagement, including client revenue figures, ad account data, and business strategies. This obligation survives termination of the engagement. Bombay Media may use aggregated, anonymised performance data (e.g. ROAS benchmarks) for marketing purposes unless the client objects in writing.
6. Client Responsibilities
Clients are responsible for providing accurate business information, timely feedback and approvals (within 48 hours where requested), and ensuring their offers, landing pages, and business practices comply with applicable laws and Meta Advertising Policies. Bombay Media is not liable for ad account restrictions resulting from client-side policy violations.
7. Termination
Either party may terminate services with 30 days' written notice. Clients are responsible for fees incurred up to the effective termination date. Bombay Media reserves the right to terminate immediately for non-payment, violation of platform policies, or conduct that is illegal or harmful.
8. Limitation of Liability
Bombay Media's total liability for any claim arising from the services shall not exceed the total fees paid by the client in the 3 months preceding the claim. Bombay Media is not liable for indirect, incidental, or consequential damages, including lost profits or lost data. Results from advertising campaigns depend on many factors outside Bombay Media's control, including market conditions, offer quality, and client follow-up processes.
9. Governing Law
These terms are governed by the laws of the United Arab Emirates (UAE) and, where applicable, the Republic of India. Any disputes shall be resolved first through good-faith negotiation, and if unresolved, through binding arbitration in Dubai, UAE.
10. Changes to These Terms
Bombay Media may update these terms from time to time. Clients will be notified of material changes via email at least 14 days before they take effect. Continued use of services after that date constitutes acceptance of the updated terms.
